By continuing to use the Services after any update becomes effective, you agree to the revised version. It is your responsibility to check this page regularly for updates.

You must be at least 18 years of age to use our Services. If you are under 18, you are not allowed to register or access any part of the Services.

Text Torrent provides users with access to a web-based communication platform designed to support business messaging. Our Services may include, but are not limited to:

1. Tools to send and manage SMS communications, including real-time two-way texting with free incoming messages
2. Integration with virtual phone numbers,
3. Access to campaign data, performance metrics, and related analytics features,
4. Tools to re-engage contacts based on previous campaign behavior, including the ability to retarget recipients who did not respond, partially engaged, or met other audience criteria.

Our Services are intended for use in jurisdictions where such functionality is legally permitted. If you choose to use the platform from a location outside the United States, you do so at your own risk and are solely responsible for ensuring that your use complies with any local laws or restrictions that may apply in your region. We do not guarantee that our Services are appropriate or available in all locations.

As a user of Text Torrent, you are fully responsible for managing your own account settings, subscription preferences, and service usage. You may cancel your subscription at any time by accessing the billing or account settings area within your dashboard.

Please note the following important policies regarding billing and cancellations:

• We do not offer refunds or account credits for unused portions of your plan.
• If you do not cancel before your renewal date, charges for the next billing cycle will apply automatically.
• Charges for legitimate usage of the Services, even if later disputed, remain non-refundable.

Once payment is successfully processed, your subscription and service features will be activated immediately. Any phone numbers linked to your account are held exclusively for your use until you choose to delete or release them.

All elements of the Text Torrent platform—including but not limited to software code, databases, features, website layout, audio-visual content, written materials, graphics, and images (collectively, the “Content”)—are either owned by or legally licensed to Text Torrent, INC. This also includes any trademarks, service marks, logos, or brand identifiers displayed within the Services (collectively, the “Marks”).
These Content and Marks are protected by applicable intellectual property laws in the United States and other jurisdictions, including copyright, trademark, and laws governing unfair competition.

You are granted limited, non-transferable access to use the Content and Marks solely for your personal use or for your internal business operations. The Content and Marks are provided “as is” and may not be copied, modified, sold, or used for any unauthorized commercial purposes.

As long as you follow these Terms—especially the guidelines under “Prohibited Activities”—Text Torrent grants you a limited, non-transferable, non-exclusive, and revocable license to:

• Access and use the Services for their intended purpose;
• View, download, or print portions of the content available to you, but only for personal use or internal business operations.

Unless explicitly stated otherwise in these Terms, you may not reproduce, distribute, license, sell, display, post, or otherwise use any part of the platform, its content, or its branding (including our name, logos, and other proprietary materials) for any commercial purpose without our prior written consent.

If you wish to request permission for any use outside the scope described here, please contact us at info@texttorrent.com. If permission is granted, you must credit Text Torrent as the source and include all copyright or ownership notices where applicable.

We retain all rights not expressly granted in these Terms. Any unauthorized use of the Services, Content, or Marks is a violation of our intellectual property rights and will result in immediate termination of your access.

Before using Text Torrent to send or upload any content, please read this section along with the “Prohibited Activities” section carefully. It explains both the rights you give us and the responsibilities you take on when submitting anything through our platform.

By using Text Torrent, you confirm and guarantee the following:

1. The information you provide during sign-up or at any time while using our Services is truthful, accurate, up to date, and complete
2. You agree to keep your account details current and to make timely updates if anything changes.
3. You have the legal authority to enter into this agreement and are willing to follow these Terms.
4. You meet the minimum age requirement under the laws of your location—meaning you are not a minor where you live.
5. You will access and interact with the platform manually, not by using bots, scripts, or any automated system.
6. You will not use our Services in any way that is illegal, unauthorized, or in violation of any laws or regulations.
7. Your use of the platform will always be in compliance with applicable rules and legal requirements.

If we determine that any information you’ve provided is false, misleading, outdated, or incomplete, we reserve the right to suspend or permanently disable your account and block you from using any part of our Services, now or in the future.

To access certain features of Text Torrent, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree not to share your password with anyone and to take reasonable steps to protect your account from unauthorized access.

We reserve the right to reject, modify, or remove any username associated with your account if we believe it is offensive, misleading, violates someone’s rights, or is otherwise inappropriate at our sole discretion.

Text Torrent offers a range of subscription options, each designed to meet different usage needs:

• Standard – $49/month with 7,000 messaging credits
• Premium – $99/month with 15,000 messaging credits
• Enterprise – $149/month with 30,000 messaging credits

All subscriptions are billed on a monthly basis and charged in advance at the start of each billing cycle. To ensure uninterrupted access to your account and services, your plan will automatically renew each month unless you choose to cancel before the next billing date.

By subscribing to any plan, you authorize recurring monthly charges to your chosen payment method unless and until you cancel your subscription.

Text Torrent currently accepts the following payment methods:

• American Express
• Discover

When making a purchase through our platform, you agree to provide accurate and up-to-date billing details, including your contact information, payment credentials, and any relevant expiration dates. It is your responsibility to ensure your account information remains current so we can process your transactions without delay and reach you if necessary.

Where required, applicable taxes will be added to your total. All transactions are processed in U.S. dollars. Prices and plan rates may change at any time, and you will be charged based on the current pricing at the time of your purchase.

By completing a transaction, you authorize Text Torrent to charge your selected payment method for the total amount due, including any applicable taxes or fees. If there is an error in pricing or billing, we reserve the right to correct it—even if payment has already been submitted or processed.

We also reserve the right to decline or cancel any order at our discretion. This may include limiting the number of purchases per account, household, or payment method, especially if we suspect the order is related to reselling or bulk distribution. Orders may be rejected if we believe they violate our usage terms or raise concerns about fraud or misuse.

By purchasing credits, subscriptions, or any other digital services through Text Torrent, you agree that all transactions are final and non-refundable, unless explicitly stated otherwise in our refund policy. All credits purchased on the platform are classified as non-physical, digital goods that are delivered instantly. As such, these purchases are not eligible for chargebacks under payment network rules that restrict disputes for fulfilled digital products.

By using our Services, you further agree to the following conditions:

• You will not initiate a chargeback or payment dispute for any successfully delivered transaction through Text Torrent.
• If you believe there has been a billing mistake, you must first contact our support team at info@texttorrent.com to resolve the issue before pursuing any external dispute process.

Filing a chargeback that violates this policy will be considered a material breach of these Terms. In response, Text Torrent reserves the right to suspend or permanently disable your account and block future access to the platform.

If a chargeback is initiated in contradiction of this policy, you agree to be held financially responsible for:

• The full amount of the original transaction;
• Any chargeback or administrative fees incurred by Text Torrent;
• All legal expenses, including court costs and collection agency fees, required to enforce this clause;
• Any other damages resulting from service disruption, investigation costs, or platform misuse caused by the chargeback.

This policy is in place to protect the integrity of our services and to prevent fraudulent or abusive financial conduct. By completing a transaction on our platform, you confirm that you have read, understood, and agreed to this provision in full

You may only use Text Torrent for lawful purposes and in accordance with the functionality we intentionally provide. Use of the Services for any activity not authorized or directly supported by us is strictly forbidden.

By using our platform, you agree not to engage in any of the following:

• Data Harvesting – Collecting or extracting content, contact details, or other user data in bulk to build a list, directory, or database without written approval from Text Torrent.
• Deception or Fraud – Attempting to mislead, impersonate, or defraud Text Torrent, its staff, or other users—especially in efforts to obtain sensitive information like passwords.
• Tampering with Security – Disabling or bypassing any security tools, protections, or content controls built into the platform.
• Reputation Damage – Taking any action that in our judgment harms, discredits, or misrepresents Text Torrent or its Services.
• Harassment or Abuse – Using the platform to harass, stalk, threaten, or harm others in any way.
• Abuse of Support – Misusing support resources or submitting false or misleading abuse reports.
• Legal Violations – Engaging in any activity that violates local, state, federal, or international laws or regulations.
• Unauthorized Linking – Framing or linking to the platform in a misleading or unauthorized way.
• Harmful Uploads – Uploading or distributing malicious code, viruses, repetitive spam, or excessive capitalized text that disrupts platform stability or user experience.
• Bot or Script Abus e – Using automated tools such as bots, scrapers, crawlers, or scripts to interact with the platform without permission.
• Removing Notices – Deleting or hiding copyright, trademark, or proprietary notices found in our content.
• Impersonation – Pretending to be another person, business, or user, or using someone else’s account credentials.
• Spyware or Tracking – Uploading or transmitting any technology used to secretly collect or transmit data, such as tracking pixels or spyware.
• Platform Disruption – Attempting to overload or interfere with the platform’s performance or the systems we rely on.
• Threats to Staff – Harassing or intimidating our employees, contractors, or agents in any way.
• Bypassing Restrictions – Circumventing access controls, usage restrictions, or limits placed on your account or any other part of the platform.
• Unauthorized Software Use – Copying, modifying, or reverse engineering any part of our software, including scripts, code, or proprietary systems.
• Automated System Deployment – Launching or distributing unauthorized tools that simulate real users, such as spiders, cheat engines, offline readers, or browser automation.
• Use of Purchasing Agents – Using a third-party agent to buy products or services on your behalf without authorization.
• Spamming or False Account Creation – Collecting contact information or creating fake accounts to send unsolicited messages or for deceptive purposes.
• Competitive Misuse – Using our Services in any way that competes with us or repurposing our content for your own commercial benefit.
• Selling Accounts – Transferring or selling your Text Torrent account to another person or entity without permission

Violations of any of the above may result in account suspension, permanent removal, legal action, and financial liability.

At this time, Text Torrent does not allow users to post, upload, or publicly share content within the platform. As such, no user-generated content features—such as forums, comment sections, or public profiles—are available through our Services.

By using Text Torrent, you acknowledge and agree that we may collect, store, and use the information and personal data you provide in accordance with our Privacy Policy and your selected preferences or account settings.

If you choose to share any ideas, suggestions, comments, or feedback about our platform, you grant us the right to use that input for any purpose—commercial or otherwise—without requiring any acknowledgment, compensation, or obligation to you.

If you use Text Torrent’s mobile application (the “App”), we grant you a limited, non-exclusive, non-transferable, and revocable license to install and use the App on your personal mobile device. This license is strictly for your internal business use or personal access to the Services, subject to these Terms

You agree not to do any of the following:

1. Reverse engineer, decompile, disassemble, or otherwise attempt to discover the App’s source code, unless allowed by law.
2. Modify, adapt, translate, or create derivative works based on the App
3. Use the App in violation of any applicable laws or regulations.
4. Remove or alter any copyright, trademark, or proprietary notices displayed within the App.
5. Use the App for commercial purposes beyond those intended by Text Torrent.
6. Share, distribute, or make the App accessible over a network that allows simultaneous use by multiple devices or users.
7. Develop a competing product or service using the App or its components.
8. Use the App to send unsolicited communications, spam, or automated queries.
9. Exploit any part of our proprietary code, interface, or design for third-party development.

If you downloaded the App through the Apple App Store or Google Play Store (collectively, the “App Distributors”), the following terms also apply:

1. This license applies only to devices that use Apple iOS or Android, and your use must comply with the terms of service set by the relevant App Distributor.
2. Text Torrent is solely responsible for maintaining and supporting the App. App Distributors are not obligated to provide any maintenance or support services.
3. If the App fails to meet a warranty covered by law, you may notify the App Distributor, who may offer a refund under their policies. To the extent allowed by law, App Distributors have no further warranty obligations.
4. You represent that you are not located in a U.S. embargoed country or on any U.S. government restricted party list.
5. You agree to follow all third-party terms that apply when using the App. For example, if you use a mobile data provider, you must ensure compliance with your carrier’s terms
6. You acknowledge that the App Distributors are third-party beneficiaries of this license and have the right to enforce its terms against you.

We reserve the right, though not the obligation, to monitor activity on the Text Torrent platform to identify violations of these Terms or applicable laws. If we determine that a user has acted unlawfully or breached these Terms, we may take any action we deem appropriate, including reporting the user to authorities or pursuing legal remedies. At our sole discretion, we may also restrict access to certain features, limit availability of services, or disable specific content if we believe doing so is necessary to protect our platform or other users. Additionally, we may remove or deactivate any files, messages, or data that place an excessive load on our systems or otherwise interfere with service performance. These rights exist to protect the security, functionality, and integrity of our Services.

If a phone number, message, or campaign is flagged by a carrier, regulator, or legal authority, we may review related account activity, investigate the matter, and disclose necessary user information to carriers, regulators, or law enforcement in order to address compliance or legal concerns.

We take your privacy and data security seriously. To understand how we collect, use, and protect your information, please review our Privacy Policy at https://texttorrent.com. By using our Services, you agree to the practices described in that policy, which forms an integral part of these Terms. Please note that our platform is operated and hosted in the United States. If you access Text Torrent from outside the U.S., you acknowledge that your personal data may be transferred to and processed within the United States, and you explicitly consent to that transfer in accordance with applicable laws.

These Terms remain in effect for as long as you continue to use the Services. However, Text Torrent reserves the right, at its sole discretion and without prior notice, to suspend or terminate your access to the platform at any time—whether for a specific reason or no reason at all. This includes the right to block certain IP addresses or disable your account if we determine that you’ve violated any part of these Terms, made false representations, or broken any applicable laws. We also reserve the right to remove your account and any associated content without warning. If your access is terminated or suspended, you may not attempt to re-register under your own name, a false name, or on behalf of someone else. In addition to disabling your account, we may pursue any legal remedies available to us, including civil, criminal, or injunctive actions, if we believe it is necessary to protect our platform or enforce our rights.

Text Torrent may update, modify, suspend, or remove any part of the Services at any time and for any reason, without prior notice. While we may revise content or features occasionally, we are under no obligation to keep information on the platform current or accurate. You acknowledge that we are not liable to you or any third party for changes in functionality, pricing, availability, or the continued operation of the Services. We cannot guarantee that access to our platform will be uninterrupted or error-free. Scheduled maintenance, system updates, or unexpected technical issues may result in temporary service disruptions. By using the Services, you accept that downtime or interruptions may occur, and we will not be held responsible for any loss, delay, or inconvenience caused by such events. These Terms do not obligate us to provide ongoing support, bug fixes, upgrades, or future releases.

If you have concerns about a charge on your account, you agree to contact Text Torrent directly before pursuing a chargeback or filing a dispute with your financial institution. We reserve the right to provide verification of service delivery, including subscription status, phone number assignments, account activity logs, screenshots, and any relevant support records.

To help resolve issues efficiently and avoid unnecessary legal expenses, both you and Text Torrent agree to attempt to resolve any disputes, claims, or disagreements (“Disputes”) informally through direct communication for a period of at least thirty (30) days before initiating formal arbitration proceedings. This informal resolution process begins once written notice of a Dispute is provided by one party to the other.

If a resolution cannot be reached during that period, the matter will be settled through binding arbitration, as the sole and exclusive method of dispute resolution (with exceptions listed below). You understand that by agreeing to arbitration, you waive your right to file a lawsuit in court or request a jury trial. The arbitration will be administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules and, where applicable, its Supplementary Procedures for Consumer-Related Disputes. Arbitration may take place in person, via documents, over the phone, or online. The arbitrator’s decision will be binding, must follow applicable law, and may be subject to review if legal standards are not upheld.

Unless otherwise required by AAA rules or applicable law, the arbitration will be conducted in New York, United States. If the arbitration costs are found to be excessive, Text Torrent will cover all arbitration-related fees. Either party may seek court assistance to enforce, modify, or confirm an arbitration award, or to stay proceedings while arbitration is pending.

If for any reason a Dispute proceeds in court rather than arbitration, both parties agree to submit to the jurisdiction of the state or federal courts located in New York, and waive any objections related to venue, personal jurisdiction, or forum non conveniens. The United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transactions Act (UCITA) do not apply to these Terms.

If any portion of this arbitration clause is deemed unlawful or unenforceable, that portion will be severed, and the remaining terms will still apply. In such cases, any Dispute not subject to arbitration will be heard exclusively in the courts specified above.

From time to time, the information provided through the Text Torrent platform may include errors, inaccuracies, or missing details—such as incorrect descriptions, pricing, or availability. We reserve the right to correct or update any such content at our discretion, and we may do so without notifying users in advance.

Text Torrent is provided on an “as is” and “as available” basis, and you agree to use the Services at your own risk. To the fullest extent allowed by law, we disclaim all warranties—whether express or implied—including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the platform will be error-free, uninterrupted, secure, or accurate. We are not responsible for any mistakes, inaccuracies, data loss, unauthorized access, service outages, or harmful code (such as viruses or malware) that may be transmitted through the platform. We also make no guarantees about the content or services offered by third parties through Text Torrent or via external links. You acknowledge that we are not liable for any transactions or interactions you engage in with third-party advertisers, vendors, or service providers, and you should exercise independent judgment and due diligence before proceeding with any such dealings.

Under no circumstances shall Text Torrent, its officers, employees, or affiliates be held liable to you or any third party for any form of damages—whether direct, indirect, incidental, special, consequential, or punitive. This includes, but is not limited to, loss of profits, revenue, data, or business opportunities arising from your use of, or inability to use, the Services—even if we were made aware of the potential for such damages in advance.

You agree to defend, indemnify, and hold harmless Text Torrent, INC, along with its affiliates, officers, employees, agents, and partners, from any claims, damages, losses, liabilities, or expenses—including reasonable legal fees—arising from: your use of the Services; any violation of these Terms; any misrepresentation or breach of warranty on your part; infringement of third-party rights, including intellectual property; or any harmful conduct toward another user connected through the platform. We reserve the right, at your expense, to take full control of any matter subject to indemnification, and you agree to fully cooperate with our defense. We will make reasonable efforts to notify you of any such claim once we become aware of it.

We may store certain information that you submit through the Text Torrent platform in order to operate, monitor, and improve our Services. While we conduct regular backups for general system maintenance, you remain solely responsible for any data you upload or generate through your account. We do not guarantee the preservation or integrity of user data, and we are not liable for any loss, corruption, or unavailability of such information. By using the Services, you agree to waive any claims against us resulting from data loss or damage.

If you are a California resident and have an unresolved complaint regarding the Services, you may contact the Consumer Assistance Unit of the Division of Consumer Services within the California Department of Consumer Affairs. These Terms, along with any policies or operational guidelines posted by Text Torrent on the platform, represent the complete agreement between you and us regarding your use of the Services. Our decision not to enforce any part of these Terms at any time does not waive our right to enforce that or any other part in the future. These Terms are enforceable to the maximum extent allowed by law. We may assign our rights and obligations under these Terms at any time without notice. We are not liable for any delay, failure, or disruption resulting from events beyond our reasonable control. If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that portion will be severed without affecting the rest of the agreement. Nothing in these Terms creates a partnership, agency, joint venture, or employment relationship between you and Text Torrent. These Terms will not be interpreted against us merely because we drafted them, and you waive any defense based on the electronic format or the absence of a physical signature.
