1. Introduction

This Acceptable Use Policy (“Policy”) is incorporated by reference into the Terms of Service ofText Torrent, INC (“Text Torrent,” “we,” “us,” or “our”) and applies to all users of our platform and Services. This Policy is designed to ensure lawful, responsible, and secure use of the Services provided throughhttps://texttorrent.com(the “Site”) and any associated systems, tools, or integrations, including but not limited to SMS messaging and Twilio-powered communications.

By accessing or using our Services, you agree to comply with this Acceptable Use Policy. If you violate this Policy, we may suspend or terminate your access to the Services without notice and pursue legal remedies where applicable.

2. Prohibited Conduct

You agree not to use the Services in any way that:

(a) Violates Laws or Regulations

  • Involves sending, storing, or distributing any content that violates applicablelocal, state, federal, or international law
  • Violates industry-specific regulations or telecom policies, including but not limited to those enforced by the CTIA, TCPA, FCC, or A2P 10DLC framework.
  • Supports or promotes illegal activities, scams, fraud, or deception

(b) Violates Messaging Rules and Platform Compliance

  • Sends unsolicited bulk SMS ("spam") or uses misleading headers, phone numbers, or sender IDs.
  • You must ensure that all recipients have provided valid express consent to receive your messages and must maintain verifiable proof of such consent (including date, time, method, IP address, and opt-in content) and provide it to us upon request.
  • Fails to include clearopt-out language (e.g., “Reply STOP to unsubscribe”) when required.
  • Messages any number that ison the Blacklist Page, has opted out, or was flagged through keyword automation on the Opt-Out Page.
  • Attempts to bypass or disable compliance tools built into the platform, such as blacklisting, keyword filters, or throttling limits.
  • Message Assistance Disclaimer: From time to time, Text Torrent may provide guidance, suggestions, or automated rewriting features to help improve deliverability and align with compliance best practices. These are provided strictly as recommendations and do not guarantee compliance or prevent carrier filtering. You remain solely responsible for the final content of your messages, for obtaining and maintaining recipient consent, and for ensuring compliance with all applicable laws and carrier rules.

(c) Abuses the Platform or Twilio Infrastructure

  • Sends excessive traffic that overloads our systems or Twilio’s infrastructure.
  • Manipulates or fakes sender IDs, delivery confirmations, or responses.
  • Uses the Services in any way that disrupts the experience of other users or the platform itself.

(d) Infringes on Others’ Rights

  • Sends messages that contain or promote content that infringes on the intellectual property, privacy, or publicity rights of any third party.
  • Uses the platform to harass, threaten, stalk, or intimidate any individual or group.
  • Engages in unauthorized impersonation or misrepresentation of another person or entity.

(e) Contains or Promotes Harmful Content

  • Distributes content that is defamatory, obscene, offensive, abusive, deceptive, discriminatory, or sexually explicit.
  • Attempts to share viruses, malware, spyware, or any software intended to damage or compromise devices, systems, or data.

3. Restricted Industries and Use Cases

The following industries or message types are strictly prohibited from using our Services:

  • Debt relief, credit repair, or loan forgiveness
  • High-interest loans, payday loans, or merchant cash advances(unless specifically pre-approved and compliant)
  • Gambling, sweepstakes, or lottery promotions
  • Illegal drugs, CBD, or unapproved supplements
  • Sexually explicit material or adult content
  • Weapons, ammunition, or explosives
  • Deceptive affiliate marketing or multi-level marketing schemes
  • Fake giveaways or phishing attempts

Use cases that fall into these categories may be suspended immediately without refund or notice

Third-Party Gateway Use: If you connect a third-party messaging gateway (e.g., Twilio, Telnyx, Plivo) to the Services, you are solely responsible for ensuring compliance with all applicable laws, carrier rules, and that provider’s terms. We are not liable for delivery failures, blocked messages, or penalties related to your use of third-party services.

4. Account Security and Access

You are responsible for maintaining the security of your login credentials and subaccounts. You agree not to:

  • Share your password or access token with unauthorized individuals
  • Create subaccounts for third parties not affiliated with your business
  • Use another user’s credentials without permission

If we detect suspicious access or security risks, we reserve the right to temporarily disable your account and require verification before reinstating access.

All account registration information must be truthful, accurate, and current. Providing false, misleading, or impersonated information to gain access to the Services will result in immediate termination and may lead to legal action.

5. System Monitoring and Enforcement

We may monitor all account activity, message traffic, and use patterns to ensure compliance with this Policy. Monitoring may include:

  • Review of message logs and phone numbers
  • Analysis of opt-out rates and complaint patterns
  • Investigation of platform abuse or fraud attempts

We reserve the right to:

  • Suspend or terminate accounts in violation of this Policy
  • Report unlawful conduct to appropriate authorities or regulators
  • Share relevant data with Twilio or other integration partners as part of incident review

We may suspend or terminate accounts immediately and without prior notice if we determine that your activity presents a legal, regulatory, or reputational risk.

6. Fees and Payments

Violations of this Acceptable Use Policy may result in any of the following:

  • Immediate suspension or termination of your account
  • Permanent blacklisting of your phone numbers or IP addresses
  • Loss of credits or subscription access without refund
  • Referral to law enforcement or regulatory bodies
  • Legal action to recover damages or enforce compliance
  • Message Formatting Disclaimer: Use of spintext, merge fields, personalization tools, or special characters (including emojis, accented letters, or non-GSM characters) may cause the final delivered message length to vary from the template. As a result, the number of credits consumed may differ from the preview. By using these features, you accept responsibility for any variations in billing.

7. Reporting Violations

If you believe someone is violating this Policy, please contact us immediately atinfo@texttorrent.com. Provide any supporting documentation or message logs so we can investigate thoroughly.

8. Updates to This Policy

We may revise this Acceptable Use Policy at any time. Changes will be posted on our website with a revised "Last Updated" date. Your continued use of the Services after such updates constitutes acceptance of the modified policy.
